1. Introduction and Acceptance of Terms

Welcome to Creative Escapes HHI (“Creative Escapes,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our studio, classes, workshops, events, products, and website (collectively, the “Services”).

By booking, registering for, attending, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use our Services.

2. Services, Registration, and Participation

2.1 Class and Workshop Registration

All participants, including guests attending private parties or group events, must register and pay all applicable fees in advance to secure a reservation. Class sizes are limited. Registration is confirmed only upon receipt of full payment.

2.2 Age Requirements and Minors

  • Unless otherwise stated, participants must be at least three (3) years old to attend classes.

  • Participants under seven (7) years old must be accompanied at all times by a registered and paying adult.

  • A parent or legal guardian must complete registration on behalf of any minor and accepts full responsibility for the minor’s conduct, safety, and compliance with these Terms.

2.3 Materials and Supplies

Unless otherwise stated in the class description, all necessary materials and supplies required for the project are included in the class fee.

Class fees do not include applicable sales tax, gratuities, or optional add-ons.

2.4 Health, Safety, and Physical Condition

By participating, you represent that you and any minors under your supervision are in good physical condition and capable of safely participating. You agree to notify Creative Escapes staff of any medical conditions, allergies, sensitivities (including chemical sensitivities), or physical limitations that may affect participation.

3. Payments, Cancellations, and Refunds

3.1 Payments

Payment must be made online through our designated booking platform or in person at the studio prior to the start of the service. We do not accept partial payments unless explicitly stated.

3.2 Participant Cancellations and Rescheduling

All sales are final. We do not offer refunds for missed classes, no-shows, or participant cancellations.

At our discretion, we may allow participants to reschedule once for a future class of equal value, provided notice is given in advance. Rescheduling is not guaranteed and is subject to availability.

3.3 Private Parties and Group Events

A non-refundable deposit is required to secure all private party or group event bookings. If a private event is canceled by the customer for any reason, the deposit will be retained.

3.4 Studio Cancellations

Creative Escapes reserves the right to cancel or reschedule classes due to low enrollment, instructor availability, weather, safety concerns, or other unforeseen circumstances. If we cancel a class, registered participants will be offered either a full refund or a credit toward a future class.

4. Studio Rules and Participant Conduct

4.1 Safety and Mess

Many workshops involve materials such as paint, resin, glass, and adhesives that may stain clothing or cause damage to personal items. Participants assume all risks associated with mess, spills, and material exposure and are encouraged to wear appropriate clothing.

Participants must follow all safety instructions provided by instructors. Failure to do so may result in removal from the class without refund.

4.2 Food, Beverages, and Behavior

Non-alcoholic drinks and snacks are permitted unless otherwise stated. Alcohol is not permitted unless explicitly approved by Creative Escapes.

We reserve the right to refuse service to or remove any participant who appears intoxicated, behaves disruptively, or poses a safety risk to themselves or others. No refunds will be issued in such cases.

4.3 Damage to Property

Participants are financially responsible for any damage to studio property, equipment, or materials caused by negligence, misuse, or willful misconduct.

4.4 Clothing and Personal Items

Creative Escapes is not responsible for damage to clothing, shoes, personal items, or accessories resulting from participation in any workshop.

5. Intellectual Property and Media Use

5.1 Ownership of Participant Artwork

Artwork created during workshops belongs solely to the participant.

5.2 Photography, Video, and Promotional Use

By attending a class or event, you grant Creative Escapes a perpetual, irrevocable, royalty-free license to photograph or record you and/or your artwork and to use such images or recordings for promotional, marketing, educational, and social media purposes, without compensation.

If you do not wish to be photographed or recorded, you must notify staff in writing prior to the start of the class.

5.3 Creative Escapes Intellectual Property

All instructional materials, techniques, lesson plans, demonstrations, handouts, and curricula remain the exclusive intellectual property of Creative Escapes and may not be copied, reproduced, distributed, or used for commercial purposes without prior written consent.

6. Assumption of Risk and Limitation of Liability

Participation in Creative Escapes activities involves inherent risks, including but not limited to slips, falls, cuts, burns, allergic reactions, chemical exposure, and property damage.

To the fullest extent permitted by South Carolina law, you voluntarily assume all risks associated with participation and release and hold harmless Creative Escapes, its owners, employees, instructors, and agents from any claims, damages, injuries, losses, or liabilities arising out of or related to participation in our Services, except where caused by gross negligence or willful misconduct.

7. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in a court of competent jurisdiction located in South Carolina.

8. Changes to These Terms

We reserve the right to modify or update these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
